The Board of Registered Nursing is the state agency that regulates registered nurses in California. The nursing practice act details the functions of the board, and this includes a program for registered nurses that are suffering from substance use disorder or mental illness. Every registered nurse has the legal obligation as a leader to make changes for his or her patients to ensure that they are receiving safe patient care (Yoder, 2019). Patient safety is the third leading cause of death in the United States, and the greatest numbers of providers are derived from nursing (Yoder, 2019). As a coworker, they are required to report the suspected chemical dependence to their immediate supervisor. All nursing individuals who matriculate after September 1, 1985 are required to have training in detection and treatment of alcohol and chemical dependency (California Nursing Practice Act). The healthcare profession gives their employees access to medications and substances. It can be a temptation for a nurse with chemical dependence to “forget” about wasting away unused narcotics. It can also be a problem if medications disappear from the medication room, and are unaccounted for. There must have previously been issues with medications because nurses are required to witness one another wasting narcotics. In addition, nurses are also required to hold each other accountable for providing the correct dosages of medications. The charge nurse can collaborate with the human resources team to report the employee to the Board of Nursing. Although it is not required by law to file a complaint with the BRN, health professionals have the ethical responsibility to protect their patients (California Board of Registered Nursing). The nurse’s code of ethics states that nurses must be vigilant to protect the patient, the public, and the profession from potential harm when a colleague’s practice seems impaired (California Board of Registered Nursing). If any nurse suspects a colleague of chemical dependency, it is their duty to take action (California Board of Registered Nursing). The Board of Registered Nursing provides support with substance use disorders or mental illness because nurses are not immune to illness. Registered nurses are eligible for the intervention program if they are licensed in California, are mentally ill or abuse substances, and they must voluntarily enter the program and consent to medical evaluation (California Board of Registered Nursing). Nurses with substance use disorder must demonstrate a change in lifestyle that supports continuing recovery and have at least 24 consecutive months of clean, random, drug tests. The intervention program is confidential, and upon completion, the board will determine if the registered nurse is able to resume nursing practices.
